GENERAL TERMS AND CONDITIONS OF SALE


1. SCOPE AND APPLICATION OF THESE TERMS

1.1 These General Terms and Conditions (“GTC”) govern the sale of products and services (“Service(s)”) offered by Laser Game Evolution® (“LGE”). They are binding on any person (“Customer”) who purchases a Service or makes a reservation for the purpose of using the Services of an LGE gaming center (“Centre”), in particular on the LGE website accessible at www. lasergame-evolution.ca including any related web or mobile application, if any (“Website”).

1.2 By purchasing or reserving one or more Services, the Customer acknowledges and is deemed to have read these T&Cs and to have accepted them without restriction or reservation.

1.3 The Customer declares to be able to contract legally under the law applicable in Quebec or to validly represent the natural or legal person in whose name he is contracting. Unless proven otherwise, the information recorded by LGE at the time of purchase or reservation constitutes full proof of the transaction between the parts.

1.4 LGE reserves the right to unilaterally modify these T&Cs at any time by publishing a new version on its Website, which will come into force upon publication. The version of the T&Cs applicable to any purchase or reservation of Services is that in force on the date of payment (or of the first payment in the case of installment payments) for the purchase or reservation in question, including the payment of a deposit, if applicable.

1.5 These T&Cs represent the entire agreement between the Customer and LGE with respect to its subject matter and replaces and cancels all other prior agreements or commitments, whether written or not, between the parties with respect to the subject matter hereof, as the case may be. applicable, including any statement by an LGE employee.

2. RESERVATION OF SERVICES

2.1 All reservations are subject to the places available for one or more games of 20 minutes each in the game rooms of the Center concerned according to the date and time slot(s) requested.

2.2 LGE reserves the right to allocate its game rooms based on reservations, at its discretion, and no claim by the Customer may relate to the allocation of game rooms carried out in a discretionary manner by LGE.

2.3 Payment of a deposit is required to confirm the reservation of any Service. For online bookings, the deposit must be paid at the time of booking. For reservations made by telephone, it is the Customer’s responsibility to call the Center concerned to make his reservation and pay the deposit via the link in his confirmation email or submission. In all cases, the deposit must be paid within a maximum of 24 hours following receipt of the email. At the end of this period, the reservation will be automatically canceled.

2.4 The Customer’s place will only be reserved following payment of the deposit by the latter and receipt of a confirmation by email sent by LGE to the Customer.

2.5 Reservations for groups made up of less than 6 players can be made a maximum of one week before the scheduled date for the provision of the Services, subject to availability in the Center concerned, and for only 2 games of 20 minutes. LGE reserves the right to mix different groups within the same game, without age restriction, all as indicated in paragraph 8 below.

3. MODIFICATION / CANCELLATION

3.1 Any request for modification relating to the number of players or to the date, time and type of provision of the Services must be communicated to LGE through the Website, by telephone or by email. Any modification will only be effective following receipt of an email confirmation from LGE. If LGE cannot accommodate the modification request, for whatever reason, LGE may agree, at its discretion either on another date for the provision of the Services, by mutual agreement with the Customer, or cancel the service and reimburse the Customer according to the reimbursement terms provided for in these GCS in the event of cancellation.

3.2 LGE reserves the right to refuse, cancel, suspend or interrupt the reservation or the provision of a Service at any time and for any legitimate reason, for example for any request that is abnormal, unreasonable or made in bad faith. or in the event of an accident or inappropriate behavior during a game by the Customer or a member of his group.

3.3 The Customer may cancel the reservation of a Service for any reason at any time before it takes place.

3.4 In the event of cancellation by the Customer for any reason whatsoever, or by LGE following a change request from the Customer or any other legitimate reason, the terms of reimbursement are as follows:

3.4.1 Full refund of the deposit if the cancellation occurs at least 10 calendar days before the date initially scheduled for the provision of the Services.

3.4.2 No refund of the deposit paid if the cancellation occurs less than 10 calendar days before the date initially scheduled for the service in order to compensate for LGE’s loss of income.

3.5 In the event of suspension or interruption by LGE due to a fault of the Customer or its group, there will be no refund.

4. SERVICES AND PRICES

4.1 Descriptions of the Services and facilities, including any images or illustrations, are displayed on the Website for informational purposes only and have no legal force.

4.2 The rates for the Services are displayed in Canadian dollars and the prices exclude all applicable taxes, unless an item is explicitly specified as including taxes. The price of the Services is that in force on the day of the order.

4.3 The total amount to be paid by the Customer is indicated on the order confirmation page. The price of the Services chosen and the applicable taxes must be paid in full before the commencement of the provision of the Services, subject to paragraph 7.3.

4.4 The base rates include the loan of a chest protector and a game gun for the game as well as access to a game room for a period of 20 minutes.

4.5 Any request for a Service not included in the Customer’s initial reservation, including the request for additional 20-minute game, will give rise to additional billing according to the rate in effect at the time of the request.

4.6 LGE reserves the right to modify its prices at any time, it being understood that in the event of a difference between the price applicable at the time of the reservation and at the time of the provision of the Services, the Services being expressly the subject of the booking will be charged based on the rates in effect at the time of booking.

5. CONFIRMATION OF ORDERS

5.1 The Customer will receive confirmation by email of payment for the order, as well as an acknowledgment of receipt of the order. The details of the Services chosen are communicated by e-mail to the Customer when ordering and recorded in the LGE system.

5.2 The communication of these confirmations does not in any way affect LGE’s rights of refusal or cancellation provided for in these GCS.

5.3 Laser tag games and other activities taking place at the Center involve a certain level of physical exercise and it is the responsibility of each Client to ensure that they have the physical abilities necessary to participate. Consequently, LGE cannot be held responsible for any damage, including accidents, injuries or death, which could be linked to a condition such as respiratory failure, heart failure, wearing a pacemaker, asthma, epilepsy, being pregnant, or any other contraindication to practicing a sports activity.

5.4 Certain areas of the Game Rooms may have a maximum height which requires some players to crouch to pass. Customer understands this and agrees to remain alert to such areas, to take care to avoid head injury, and to pass through such areas relying solely on their own judgment as to their physical ability to do so.

6.DISCOUNTS

6.1 Any Customer wishing to pay by applying a discount, coupon or promotional offer (“Discount”) must invoke it and present the supporting documents before making the required payment on the day of the service.

6.2 No Discount will be applied retroactively once a payment has been made.

7. PAYMENT TERMS

7.1 For payments in stores, the following methods of payment are accepted for individuals, companies and associations: cash, credit card and debit card.

7.2 Deposit payments must be made exclusively by credit card, either online when making the reservation or by following the link in the confirmation email received when making the reservation. Gift cards or discounts will in no case be applied to a deposit, but only to the balance payable at the time of the provision of the Services by LGE.

7.3 Checks and bank transfers are only accepted for corporate and school Clients. Corporate and school Clients must pay their invoice within 30 days of the date the Service is provided, failing which a penalty of $50 per day of delay will automatically apply until on the day of full payment of the sums due, including any sum accumulated as a penalty.

8. NUMBER OF PLAYERS AND PRIVATIZATION

8.1 In the event of a reservation for less than 6 players, the Customer and the other players for whom he makes the reservation may be paired with other groups of less than 6 players for 2 games of 20 minutes exclusively according to the sole discretion of LGE, without any guarantee of age group or otherwise. However, if the Customer requests and pays for a private game and pays the related costs, subject to availability, the Customer and the other players for whom he makes the reservation will not be mixed with players who are not part of the group of players for which the Customer made the reservation.

8.2 The minimum price for a private game is the rate in force for 6 players. In the event of a reservation of a private game for less than 6 players, the price for the part will not be reduced. Beyond 6 players, the price for each additional player will be applied in addition according to the rates in force.

9. LOCKERS

9.1 Lockers are available to the customer if he wishes to deposit his personal items during his time on site.

9.2 A padlock can be lent if the customer wishes. In exchange for which he will be asked for a personal object (for example, car key) so that he remembers to return the padlock at the end of the session.

9.3 LGE cannot under any circumstances be held liable for the theft, loss, omission or disappearance for any reason whatsoever of Customers’ objects, clothing or accessories or for any damage to them, except in the event of gross or intentional negligence.

10. DRESS CODE

10.1 The Client and any accompanying person must come to the Center in clean, non-provocative and appropriate clothing for practicing physical activity indoors. Wearing a sweater or tank top under the game chest pad is mandatory.

10.2 The Customer must ensure that they have appropriate clothing to play in a safe manner. Closed running shoes are recommended.

11. DURATION OF THE GAMES

11.1 The duration of a game is 20 minutes, and includes the time for putting on equipment, as well as entering and exiting the mazes. However, the duration of a game excludes the instruction time before the game and the remittance of the scores after it.

11.2 We recommend that the Customer be present 10 minutes before the scheduled start of his registration so that it can be done on time. Any delay is likely to encroach on the time of the parties, or the cancellation thereof, without refund or discount.

12. GAME EQUIPMENT

12.1 All equipment loaned to the Customer remains the exclusive property of LGE. Customer will be responsible for loss or damage to any equipment, including gaming chest pads and guns, in addition to normal wear and tear.

12.2 In the event of loss, breakage or damage to the equipment, the Customer undertakes to pay LGE, directly on site before leaving the Centre, the costs indicated in the appendix to these GCS for the purpose of replacing any damaged equipment. (except damage due to normal wear and tear) or lost by a Customer.

13. PRIVATE EVENTS – ALCOHOL PERMIT FOR A MEETING

13.1 It is possible to reserve an entire Center for the holding of a meeting. The applicable rates will be sent on request (“Private Event”).

13.2 An alcohol permit may be requested by the Customer for a private Event, in accordance with the legislation in force. However, it is the customer’s responsibility to take the steps to obtain it and to pay the costs. Any consumption of alcohol inside the Center or on adjacent facilities is prohibited without such a permit.

13.3 Notwithstanding the foregoing, it is prohibited at all times to participate in a laser tag game at a Center under the influence of alcohol or any other substance that may affect judgment or behavior, including cannabis.

13.4 During a Private Event, the Customer and each person attending it is fully responsible for their behavior, including any consumption of alcohol. Beyond providing access to the Center locations available for holding a Private Event, LGE disclaims, to the fullest extent permitted by law, any liability in connection with the Private Event, including any responsibility for monitoring or supervision, which responsibility remains at all times the sole responsibility of the Customer and any other organizer of the Private Event, if applicable.

13.5 In the event of a claim from a third part relating to a Private Event, the Customer and any organizer of the Private Event on whose behalf the Customer has acted, if applicable, shall hold LGE harmless from any civil liability for any prejudice whatsoever be suffered by any person participating in a Private Event, except in the event of gross or intentional negligence attributable to LGE.

14. SECURITY

14.1 All participants are responsible for adopting prudent and safe behavior on the premises of the Centre. LGE reserves the right to expel any Customer who contravenes these T&Cs, compliance with the equipment or compliance with the safety and game rules presented to the Customer before the game, in particular, and without limitation, the prohibition on having physical contact, to crawl on the ground, to run, to jump or play on the stairs, to climb the walls of the maze or to remove their play chest during the game.

14.2 In addition, LGE reserves the right to expel, according to the judgment and at the sole discretion of LGE employees, any Customer who presents to the Center in a state of intoxication or under the influence of any substance likely to affect their judgment or behavior, including cannabis, or who engages in behavior that is aggressive, violent, disruptive, or that may affect the general experience of other customers.

14.3 In the context of such expulsion, it is agreed that the Customer will not be entitled to any refund or financial compensation.

14.4 The reception, game rooms and other areas available to the public are likely to be equipped with surveillance cameras, in order to protect staff and customers.

15. LIMITATION OF LIABILITY AND ASSUMPTION OF RISKS

15.1 LGE shall not be liable for any damage including in particular any injury suffered through recklessness, accidentally or by contravening the safety and game rules presented to the Customer before the game or any provision herein, or following use equipment, unless, if you are a consumer subject to Quebec consumer protection law, the damage results from the fault of LGE or its representatives.

15.2 LGE is not responsible for carrying out any parental monitoring or supervision; this responsibility remains at all times the sole responsibility of the holder of parental authority or the responsible adult in the presence of minors, as the case may be.

15.3 Laser tag games and other activities taking place at the Center involve a certain level of physical exercise and it is the responsibility of each Customer to ensure that they have the physical abilities necessary to participate. Consequently, LGE cannot be held responsible for any damage, including accidents, injuries or death, which could be linked to a condition such as respiratory failure, heart failure, wearing a pacemaker, asthma, epilepsy, being pregnant, or any other contraindication to practicing a sports activity.

15.4 By signing, the Client confirms that he is not, to his knowledge, a carrier of a contagious disease which could be transmitted to other clients and staff in the Centre.

16. COMPLAINTS

16.1 If necessary, the Customer may submit any complaint by contacting the company using the following contact details: Laser Game Evolution Canada, 4497 ​​boulevard Guillaume-Couture, Lévis (Québec) G6W 6M9, Canada.

17. INTELLECTUAL PROPERTY RIGHTS

17.1 The trademarks, domain names, products, software, images, videos, texts and more generally any element subject to intellectual property rights belonging to LGE (“IP”) are and remain the exclusive property of LGE. No transfer of rights relating to the IP is intended or carried out by these T&Cs. Any total or partial reproduction, modification or use of the IP for any reason whatsoever is strictly prohibited.

18. FORCE MAJEURE

18.1 LGE shall not be liable to the Customer, nor shall it be deemed to have breached its obligations or to have breached its obligations under these GCS in the event of any failure or delay in the performance of any of the Services Terms, when and to the extent that such failure or delay is caused by or resulting from acts beyond LGE’s reasonable control, including, but not limited to: (a) acts of God , (b) flood, fire, earthquake, tsunami or explosion, (c) war, invasion, hostilities (whether war be declared or not), terrorist threats or acts, riot or other civil unrest, (d) ministerial orders or law, (e) actions, embargoes or blockades, (f) action of any governmental authority, (g) national or regional emergency, (h) strikes, work stoppages or slowdowns or other industrial disturbances, and ( (i) shortage of power generation facilities or other public services.

19. PROTECTION OF PERSONAL INFORMATION

19.1 Customer personal information collected by LGE will be treated in accordance with the Act respecting the protection of personal information in the private sector as well as in accordance with LGE’s Privacy Policy available here: Click Here.

20. ENFORCEABILITY OF THE T&Cs

20.1 If a stipulation of these T&Cs is declared illegal, void or unenforceable by a competent authority, then this stipulation may be detached from the rest of the T&Cs and will have no effect on the validity and enforceability of the other stipulations.

20.2 For the purposes of proper execution of the order, the Customer undertakes to provide his true identification elements.

21. APPLICABLE LAW AND JURISDICTION

21.1 These T&Cs are governed by the law applicable in the province of Quebec and must be interpreted in accordance with this law. Any dispute relating thereto must be submitted exclusively to a competent court in the judicial district of Quebec, province of Quebec.
